Melanie O. focuses her practice on appeals and complex commercial litigation.  She has extensive experience in both briefing and arguing appellate matters in the U.S. Court of Appeals for the Second Circuit, the New York Court of Appeals and all of the lower New York appellate courts, as well as both analyzing and briefing a wide variety of legal issues in litigation matters in federal and state courts throughout the country.  As an independent contractor, she has worked extensively with New York law firms and currently is Of Counsel at a New York firm.

Melanie graduated magna cum laude from Harvard Law School in 1994 (and was editor of Harvard Law Review) and subsequently completed a clerkship with then-Chief Judge Jon O. Newman of the U.S. Court of Appeals for the Second Circuit. Melanie earned her B.A. from Yale College. Before establishing her own practice in 2009, Melanie spent over six years in the New York State Attorney General’s Office’s Appeals & Opinions Division, where she was awarded a commendation by then-Attorney General Eliot Spitzer for winning some of the most challenging cases confronted by that Division during her tenure there. Prior to joining the New York State Office of the Attorney General, Melanie practiced for two years in the Appellate & Supreme Court Practice Group established at Mayer Brown in New York, which was one of the first large firms in the U.S. to have such a specialized practice predominantly aimed at Second Circuit and New York state appeals. Melanie also previously practiced general and commercial litigation at Wachtell, Lipton, Rosen & Katz and was associated with the boutique Supreme Court litigation practice of Harvard Law Professor and constitutional scholar Laurence H.
